Terms of Service
The agreement between you and MigratePress for the plugin, the sign-in service and this website.
These Terms of Service ("Terms") govern your use of the MigratePress WordPress plugin, the MigratePress sign-in service at migratepress.bdwebguy.com/mgp-oauth, and this website (together, the "Service"). By installing the plugin or connecting a storage destination through our sign-in service, you agree to these Terms.
1. What the Service is
MigratePress is software you install on your own WordPress server. It creates backup archives of your site, uploads them to a cloud storage account that belongs to you, and restores or migrates the site from those archives. We do not host your website, we do not store your backups, and we do not operate your storage account.
The sign-in service exists for one purpose: to hold the registered OAuth application for Google, Dropbox and Microsoft so that you can connect a storage account by signing in, instead of registering an application of your own. It completes the authorisation exchange and hands the resulting tokens to the site that started it.
2. Eligibility and your account
You must be at least 16 years old and able to enter into a binding agreement. You are responsible for the WordPress site the plugin runs on, for the storage account you connect, and for keeping the credentials of both secure.
3. Acceptable use
- Use the Service only for sites and storage accounts you own or are authorised to administer.
- Do not use the Service to store or transfer unlawful content, malware, or material you have no right to copy.
- Do not attempt to overload, probe, reverse-engineer or bypass the security controls of the sign-in service, and do not automate it beyond ordinary plugin use.
- Do not use the Service in a way that breaches the terms of Google, Dropbox, Microsoft, Amazon or any other provider whose storage you connect.
We may block a site or an address from the sign-in service if it abuses these rules or threatens the availability of the Service for others.
4. Third-party services
Google Drive, Dropbox, OneDrive, Amazon S3, Backblaze B2, Wasabi, DigitalOcean Spaces, Cloudflare R2, Nextcloud and FTP servers are operated by third parties, not by us. Your use of them is governed by their own terms and privacy policies. We are not responsible for their availability, pricing, storage limits, or for data they lose or refuse to return.
Your use of Google Drive through MigratePress is also subject to the Google Terms of Service. Our handling of data received from Google APIs is described in our Privacy Policy.
5. Backups are your responsibility
A backup tool reduces risk; it does not eliminate it. You are responsible for verifying that your backups complete, for testing that they restore, and for keeping copies where you can reach them. We strongly recommend keeping at least one backup outside the site being protected.
6. Availability
The Service is provided on an "as is" and "as available" basis. We may modify, suspend or discontinue any part of it, including the sign-in service, and we will give reasonable notice where a change would break existing connections. If the sign-in service is unavailable, the plugin can still be used with your own application credentials.
7. Intellectual property
The MigratePress name, logo and website content belong to us. The plugin is licensed under the GNU General Public License version 2 or later; nothing in these Terms limits the rights that licence grants you in the plugin's code.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any backup will be complete or restorable in every environment.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, revenue, profits or goodwill, arising out of or related to the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 100.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your breach of these Terms or of a third-party provider's terms.
11. Termination
You may stop using the Service at any time by disconnecting your storage destinations and uninstalling the plugin. We may suspend or terminate access to the sign-in service for a site that breaches these Terms. Sections 7 to 10 survive termination.
12. Changes to these Terms
We may update these Terms. The date at the top of this page shows the current version, and continued use of the Service after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules, and the courts of Bangladesh have exclusive jurisdiction over disputes — except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.
